Behavioral Law and Economics presents new findings in cognitive psychology and behavioral economics, which show that people are frequently both unselfish and over-optimistic; that people have limited willpower and limited self-control; and that people are "boundedly" rational, in the sense that they have limited information-processing powers, and frequently rely on mental short-cuts and rules of thumb. Understanding this kind of human behavior has large-scale implications for the analysis of law, in areas including environmental protection, taxation and tax compliance, constitutional law, voting behavior, punitive damages for civil rights violations, labor negotiations and strikes, and corporate finance. Behavioral Law and Economics offers many new insights into these fields and suggestions for legal reform. With a better knowledge of human behavior, it is possible to predict the actual effects of law, to see how law might actually promote society's goals, and to reassess the questions of what law should be doing.

There are several prominent legal scholars who work in the interface of social theory and law, but Cass Sunstein is, to my mind, one of the very few really innovative thinkers with full control of social theory. This edited collection shows that the approach he has been working on for the past several years, has finally come of age.

The first synthesis of law and economics took place several decades ago, based on the seminal work of Nobel prize winning Chicago economist Ronald Coase. The synthesis was based on the so-called "rational actor model" (often called homo Economicus) that can be derived from certain axiomatic, mathematics-like principles, based on the notion of self-interest and utility maximization. This was a major breakthrough in social theory and policy.

But the "rational actor model" has been shown to be systematically violated by real human beings, and behavioral economics arose to ammend the "rational actor model" to fit the reality. It's not that people are irrational, but rather the concept of rationality used in the traditional theory is seriously wanting. If you're interested in this larger backdrop to the present book, there is a marvelous new book on the subject edited by its creators, Daniel Kahneman and Amos Tversky, called "Choices, Values, and Frames."

The introductory chapters of Behavioral Law and Economics are refreshingly clear and free of jargon. These are followed by some of the most important articles that have been written on the topic over the past several years.

Behavioral law and economics is not just some academic field. It is absolutely, front and center, critical to political philosophy and the policy sciences in general. This book is for both expert and layperson alike---a real tour de force.

        These thirteen papers and accompanying commentaries are the first fruits of an ongoing research project that has concentrated on developing simulation models that incorporate the behavioral responses of individuals and businesses to alternative tax rules and rates and on expanding computational general equilibrium models that analyze the long-run effects of changes on the economy as a whole.

        The principal focus of the project has been on the microsimulation of individual behavior. Thus, this volume includes studies of individual responses to an over reduction in tax rates and to changes in the highest tax rates; a study of alternative tax treatments of the family; and studies of such specific aspects of household behavior as tax treatment of home ownership, charitable contributions, and individual saving behavior. Microsimulation techniques are also used to estimate the effects of alternative policies on the long-run financial status of the social security program and to examine the effects of alternative tax rules on corporate investment and of foreign-source income on overseas investment.

        The papers devoted to the development of general equilibrium simulation models to include an examination of the implications of international trade and capital flows, a study of the effects of capital taxation that uses a closed economy equilibrium model, and an examination of the effect of switching to an inflation-indexed tax system. In the volume's final paper, a life-cycle model in which individuals maximize lifetime utility subject to a lifetime budget constraint is used to simulate the effects of tax rules on personal savings.

                    From the author: This paper explores the behavioral response of taxable bequests to estate taxation. To gauge its effects, the estate tax is converted to an equivalent income tax. This highlights the importance of expected rates of return, and also makes it possible to compare effective tax rates on saving over time. Using data on federal revenues from the estate tax over the past 50 years, and employing the equivalent income tax rate measure, the findings suggest that estate taxes have a dampening effect on the reported size of taxable estates. Estate taxation seems to depress taxable bequests by almost ten percent.

The first section (18 chapters) covers such topics as genetic stability of microspore-derived doubled haploids, transformation of pollen and microspores, gametoclonal variation, bread-making quality of wheat doubled haploids, DNA amplification of doubled haploids, RFLP mapping with haploids, genetics of green plant regeneration from anther culture, combining mutation breeding with haploidy for the improvement of rapeseed, segregation distortion among anther-derived plants, chromosome engineering, self-incompatibility and pollen rejection, statistical models for the detection of quantitative trait loci, haploid protoplasts, gametosomatic hybrids, potential of using dihaploid/diploid genotypes in breeding potato by somatic hybridization, cryopreservation, prospects of microspore-derived embryos for artificial seeds and the future prospects for crop improvement through anther and microspore culture. Section 2 (3 chapters) is concerned with genetic transformation of wheat and Petunia via pollen, and rice through microspore-derived protoplasts.

The plants covered include vegetable crops ( Allium spp., Capsicum, Chicorium, Cucumis, Solanum melongena, Solanum tuberosum); fruit crops ( Malus, Fragaria, Vitis); and other miscellaneous crops ( Beta, Coffea, Ginkgo, Glycine, Medicago, Saccarum, Sinocalamus latiflora, forest trees). Some chapters also cover protoplast manipulation and genetic transformation.

The chapters contained review haploidy in cereal crops including rice ( Oryza sativa), maize ( Zea mays), wheat ( Triticum aestivum), barley ( Hordeum vulgare), triticale, ryegrass ( Lolium spp.), sorghum ( Sorghum bicolor), buckwheat ( Fagopyrum esculentum), pearl millet ( Pennisetum glaucum), rye ( Secale cereale) and oat ( Avena sativa). Some chapters also include a discussion of the potential of protoplast manipulations and genetic transformation of the particular crop under discussion.

The final Section 3 comprises miscellaneous plants including various fruit, vegetable, or specialty crops (asparagus ( Asparagus officinalis), tobacco ( Nicotiana spp.), cotton ( Gossypium spp.), gynogenic haploids in angiosperms, Citrus, tomato ( Lycopersicon esculentum), and interspecific somatic hybrids of potato ( Solanum brevidens and S. tuberosum)).
