Law As a Social System (Oxford Socio-Legal Studies)
Niklas Luhmann Manufacturer: Oxford University Press, USA ProductGroup: Book Binding: Hardcover Similar Items:
ASIN: 0198262388 |
Book Description
Modern systems theory provides a new paradigm for the analysis of society. In this volume, Niklas Luhmann, its leading exponent, explores its implications for our understanding of law. Luhmann argues that current thinking about how law operates within a modern society is seriously deficient. In this volume he lays out the theoretical and methodological tools that, he argues, can advance our understanding of contemporary society and, in particular, of the identity, performance, and function of the legal system within that society. In systems theory, society is its communications: they are its empirical reality; the items that can be observed and studied. Systems theory identifies how communications operate within a physical world and how different sub-systems of communication operate alongside each other. In this volume, Luhmann uses systems theory to address a question central to legal theory: what differentiates law from other parts of society? However, unlike conventional legal theory, this volume seeks to provide an answer in terms of a general social theory: a methodology that answers this question in a manner applicable not only to law, but also to all the other complex and highly differentiated systems within modern society, such as politics, the economy, religion, the media, and education. This truly sociological approach offers profound insights into the relationships between law and all of these other social systems.

Rules and Regulators (Oxford Socio-Legal Studies)
Julia Black Manufacturer: Oxford University Press, USA ProductGroup: Book Binding: Hardcover ASIN: 0198262949 |
Book Description
Julia Black's book is the first authoritative study of rulemaking in one of the most important areas of economic life: financial services. The books has three main aims: first, to build a jurisprudential and linguistic analysis of rules and interpretation, drawing out the implication of these analyses and developing quality proposals for how rules could be used as instruments of regulation. Second, it interprets that analysis and set of proposals with an empirical study of the formation and use of rules in a particular regulatory system: financial services, and third, it evaluates the nature of the rulemaking process. The author's main case study, examining the use of self-regulation in the financial services sector, complements the detailed analysis of rule formation and uses. The book will be an invaluable addition to the libararies of all administrative lawyers and anyone with an interest in the provision and regulation of financial services.

Realistic Socio-Legal Theory: Pragmatism And A Social Theory of Law (Oxford Socio-Legal Studies)
Brian Tamanaha Manufacturer: Oxford University Press, USA ProductGroup: Book Binding: Hardcover Similar Items:
ASIN: 0198265603 |
Book Description
Combining philosophical pargmatism with a methodological foundation, Tamanaha formulates a framework for a realistic approach to socio-legal theory. The strengths of this approach are contrasted with that of the major schools of socio-legal theory by application to core issues in this area. Thus Tamanaha explores the problematic state of socio-legal studies, the relationship between behaviour and meaning, the notion of legal ideology, the problem of indeterminacy in rule following and application, and the structure of judicial decision making. These issues are tackled in a clear and concise fashion while articulating a social theory of law which draws equally from legal theory and socio-legal theory.

ASIN: 0198763530 |
Book Description
Why we punish, who we punish and how we punish are central elements of any discussion of the role of law in modern society. In this impressive and timely collection, two leading experts on the theory of punishment have selected a range of articles which have made important and influential contributions to the ways in which punishment is understood in contemporary society. The collection is introduced by a lengthy and original discussion of the key concepts of punishment, and each article is prefaced by a short introduction setting out the issues to be discussed. Throughout the book the aim of the editors is to demonstrate how complex the concept of punishment is, and to illustrate how an understanding of punishment is vitally important for students of law and society.

Cause Lawyering: Political Commitments and Professional Responsibilities (Oxford Socio-Legal Studies)
Manufacturer: Oxford University Press, USA ProductGroup: Book Binding: Paperback Similar Items:
ASIN: 0195113209 |
Book Description
Why do some lawyers devote themselves to a given social movement or political cause? How are such deeds of individual commitment and personal belief justly executed, given the ideals of disinterested professional service to which lawyers are (in theory, at least) supposed to adhere? What can we learn from such lawyers about the relationship between law and politics? Cause Lawyering is a wise and varied collection of responses to these questions, featuring a number of distinguished legal scholars concerned with anti-poverty lawyers, lawyers who work against capital punishment, immigration lawyers, and other lawyers working to end oppression. Editors Austin Sarat and Stuart Scheingold have assembled here a valuable cross-national portrait of lawyers compelled to sacrifice financial gain so as to use their legal skills in the promotion of a more just society. These telling and important essays fully explore the relationship between cause lawyering and the organized legal professions of many different countries--the US, England, South Africa, Israel, Cuba, and so forth. They describe the utility of law as a resource in political struggles and, conversely, highlight the constraints under which lawyers necessarily operate when they turn to politics. Some provide broad theoretical overviews; others present rich case studies. Advancing a fundamental argument about the very nature of the legal profession, this book explains the strategies that cause lawyers deploy, as well as the challenges they face in trying to be legally astute and effective while remaining politically devoted and aware. Although it is a controversial way of practicing law, cause lawyering, as explicated in the essays in this volume, is indeed indispensable to the legitimization of professional authority.

The Justice of Islam: Comparative Perspectives on Islamic Law and Society (Oxford Socio-Legal Studies)

Book Description
One out of five people in the world today lives subject to Islamic law, but stereotypes of rigid doctrine or harsh punishment obscure an understanding of the values and style of reasoning that characterize everyday lslamic adjudication. By considering its larger social and cultural context Islamic law is shown to be a kind of common law system: justice is sought through a careful assessment of persons, more than facts, and justice resides not in equality but in a quest for equivalence. Through ordinary court proceedings the style of reasoning is seen to be embedded in a set of cultural assumptions, thus rendering the study of Islamic legal proceedings a window on Muslim society generally. Using data ranging from the courts of North Africa to the treatment of Islam in American courts, from a reinterpretation of the Prophet's sociological jurisprudence to the analysis of Islamic concepts of responsibility and trust these essays demonstrate the enduring appeal of Islamic law in the lives of everyday adherents.

Revolution and the Making of the Contemporary Legal Profession: England, France, and the United States (Oxford Socio-Legal Studies)
Michael Burrage Manufacturer: Oxford University Press, USA ProductGroup: Book Binding: Hardcover ASIN: 0199282986 |
Book Description
The revolutions of France, the United States, and England each inspired dreams of creating legal institutions that did not depend on specialist intermediaries, and, in different ways, provoked attacks on the existing rules and government of the legal profession more widespread and severe than at any other time in their history. These dreams came to naught and, sooner or later, the professions recovered, but their revolutionary experiences nevertheless had a lasting impact on their subsequent organization, and help to explain why three previously convergent professions should diverge as their societies industrialised. The social upheaval of industrialization may also help to explain many of their peculiarities down to the present day: why, for instance, French advocates imposed such strict ethical obligations on themselves, from which they were only released by the state in 1992, why American lawyers should be the first to be at ease in the market, but faced intractable problems of professional self-government, why two professions should emerge in England, both with a high degree of self-government, and both long indifferent to law schools and to the market for legal services. Since lawyers were the first occupation to organize as a profession, this insightful comparative inquiry then asks what their experience might tell us about other organized occupations in these three societies, and the difference between their educational institutions, their division of labour, their civil societies and lesser forms of government, and about the ways they have been stratified and formed classes.

Hubble Space Telescope: New Views of the Universe

In April 1990, the space shuttle Discovery carried the Hubble Space Telescope to an altitude of some 600 kilometers above the Earth, where it has since been delivering images of the distant heavens to scientists below. Despite disappointing early results--the telescope's mirror and camera were revealed to have significant flaws, which were quickly repaired--Hubble has yielded extraordinary views, including stunning images of the birth, death, and occasional misfortunes of stars and close-up details of our planetary neighbors (such as views of the retreating Martian polar ice cap throughout the summer, exposing the great sand dunes that lie beneath, and of a Neptune beset by upper-atmospheric storms).Hubble's work has been an important adjunct to other astronomical research, allowing scientists, for one thing, to age-date star clusters far beyond our own galaxy and to propose an age for the universe of about 12 billion to 16 billion years. It has also inspired lay readers with its trove of magnificent photographs, of which this book gathers more than 100 taken over Hubble's years of duty. (NASA plans to replace Hubble with a larger successor in 2009.) The images are accompanied with a well-written explanatory text, altogether adding up to a volume that rewards repeated visits by readers of all ages. --Gregory McNamee
Book Description
How did the universe begin? How big is it? What is it made of? What is its ultimate fate? These are some of the questions that scientists have been investigating with the Hubble Space Telescope since its launch in 1990. Not only is Hubble providing us with an unprecedented amount of information about the universe, but its breathtaking images-disseminated in the press and over the Internet-have excited more people around the world than any other images made in the last decade. This fabulous, poster-size paperback on Hubble's dramatic discoveries-prepared to accompany a major Smithsonian Institution exhibition that will travel across the United States for several years-presents the awesome Hubble images of nebulae, emerging stars, and other celestial phenomena that have electrified us all. Far more affordably priced than previous Hubble books-and the first one prepared by the Space Telescope Science Institute (STScI), which operates the telescope for NASA-this dramatic and beautiful work lets readers shoot for the stars.
