                      Book Description

First published by George Allen & Unwin in the 1950s, this collection reprints three classic volumes on Jeremy Bentham's economic writings. Also including historical introductions and collections of passages from Bentham's non-economic writings, this is an essential resource for students and researchers alike.

Volume 1 covers the period 1787-1795 and contains The Defence of Usury, the Manual of Political Economy in its authentic form, and two financial treaties that reflect Bentham's work to find a way in which government could be carried on without taxation.

Volume 2 contains all the writings that are grouped around Bentham's boldest idea-the proposal of a "circulating currency"-a government sponsored currency, which would be both a kind of savings certificate and a kind of paper money. The roots of this proposal are illustrated in two pamphlets from 1794-96, along with subsequent pamphlets and discussions, which show Bentham's unsuccessful negotiations with the treasury on this matter.

Volume 3 takes as its main theme the demand for the legislative control of the banking trade, with the aim of preventing the inflationary reduction of fixed incomes.

If Raz and Dworkin disagree over how law should be characterised, how are we to go about adjudicating between the rival theories which they offer us? This work tackles such methodological or meta-theoretical issues, engendering rigorous debate.

                              Book Description

The 'reparational turn' in the field of law has resulted in the increased use of so-called 'informal' approaches to conflict resolution, including primarily the three mechanisms considered in this book: mediation, restorative justice and reparations. While proponents of these mechanisms have acclaimed their communicative and democratic promise, critics have charged that mediation, restorative justice and reparations all potentially serve as means for encouraging citizens to internalize and mimic the rationalities of governance. Indeed, the critics suggest that informal justice's supposed oppositional relationship to formal justice is, at base, a mutually reinforcing one, in which each system relies on the other for its effective operation, rather than the two being locked in a struggle for dominance.

This book contributes to the discussion of the confluence of informal and formal justice by providing a clearer picture of the justice 'field' through the notion of the 'informal/formal justice complex.' This term, adapted from Garland and Sparks (2000), describes a cultural formation in which adversarial/punitive and conciliatory/restorative justice forms coexist in relative harmony despite their apparent contradictions. Situating this complex within the context of neoliberalism, this book identifies the points of rupture in the informal/formal justice complex to pinpoint how and where a truly alternative and 'transformative' justice (i.e. a justice that challenges and counters the hegemony of formal legal practices, opening the field of law to a broader array of actors and ideas) might be established through the tools of mediation, restorative justice and reparations.

                                Book Description

A Penchant for Prejudice combines a detailed empirical study of the decision-making practices of judges with a sophisticated theoretical argument which exposes contemporary myths about judging and suggests methods of incorporating the inevitable bias that is detected in this and other studies. Based on a unique study of the decisions of Social Security judges, the book challenges the meaning of judicial impartiality. Linda G. Mills finds that, in practice, bias is a consistent dimension of what is considered "impartial" decision-making. The results reveal that impartiality as the legal system now defines it, is itself a form of bias, and that a historically and contextually sensitive definition of bias, one which takes account of the communities and cultures that come to be judged in the legal system, must overcome the modern dualistic notion of imparitality as the exclusion of bias in order to respond to needs of the diversity of applicants and the judges who adjudicate their claims. According to Mills, the judicial bias she found reflected in her study seems not only to essentialize and stereotype applicants but also prevents judges from engaging vulnerable claimants in a way that the legal process positively demands.
A Penchant for Prejudice will be of interest to students and scholars of law, judicial decisionmaking, and discrimination.
Linda G. Mills is Assistant Professor of Social Welfare and Law, University of California, Los Angeles.
