Today’s marketplace has become one where larger cash-rich organizations can take advantage of mergers and acquisitions at “bargain” prices. As the world’s largest telecommunications infrastructure companies have been looking to sell off software assets for quick cash, the current market conditions have forced sale prices that are significantly below the previous purchase prices. Amdocs, Ltd., known as one of the world’s largest billing and customer care solutions providers, took advantage of the “fire sale” prices and purchased the assets to Clarify, Inc. from Nortel Networks on October 1 for $200 million. Considering that Nortel’s acquisition price for Clarify two years before was $2.1 billion, Amdocs clearly got a good deal. While the specifics of the human and technology assets continue to be organized and integrated into the Amdocs solution portfolio, Amdocs also gains a strong customer base of more than 250 service providers, as well as customers in financial services and other complementary markets. Vendors such as Amdocs that have the financial capabilities to make these types of purchases are certainly getting a lot of value for the dollar. With sale prices like this, the Yankee Group expects to see similar acquisitions by other cash-rich software-oriented organizations (such as Convergys Corp., CSG Systems, DST Systems, and PeopleSoft) that have an opportunity to build on their existing leadership positions, expand and upgrade their product portfolios, and even enter new vertical markets outside of Tier 1 communications. Nortel’s sale of Clarify continues the trend of North American network equipment manufacturers (NEMs) de-emphasizing their software focus and returning to their strengths in telecommunications hardware. With rumors of Lucent expecting to sell Kenan Systems before the end of the year, ADC remains one of the few NEMs still dedicated to its software business, which includes billing assets from Saville Systems. As the landscape continues to change, the Yankee Group takes a look at the new reality facing the communications software industries of billing, OSS, and CRM: Why did the expected “marriage” of the NEMs and their OSS brethren end as just an “affair”? The bibliography lists the literature and State practice on the question of recognition in international law for the last two hundred years. It contains books and articles, ie. contributions to journals and other collected works such as Festschriften and Encyclopaedias, as well as (published and unpublished) theses, pamphlets, compilations of diplomatic documents and case notes. As many of the monographs on recognition in international law will not be available in all libraries, book reviews have been included in the bibliography in order to enable the user to decide whether it may be advisable to order a certain work by inter-library loan. Its 4,500 entries are arranged systematically according to subject categories in fourteen main sections. Each main section is further subdivided with ever-increasing specificity into sub-sections on codification, codification attempts, general studies, studies of certain recognition questions and studies of specific recognition cases. The bibliography employs a broad meaning of recognition. It is not restricted to the question of status of an authority or entity in international law but encompasses also the question of relations with it. As many of the recognition cases must be considered, and can only be understood, against their historic, political and sometimes even economic background, the bibliography includes not only purely legal treaties but also publications of a primarily historical, political or economic content which incidentally deal with aspects of recognition in international law. This is reflected by the titles of the 730 journals from more than 50 countries in 20 different languages which have been used to compile the bibliography. The bibliography contains both an author and a comprehensive subject index to enable users to locate works of a particular writer or a specific problem.
