    Book Description

This book, the first in a new series produced by the Pension Research Council of the Wharton School in collaboration with Oxford University Press, explores ways to enhance retirement security in a volatile financial environment. Mitchell and Smetters begin by assessing the myriad retirement risks confronting employees, retirees, employers, and governments, and it shows how stakeholders can work to reinvent pensions that perform well in a competitive global setting. Contributors then indicate how pension systems can be better designed to help protect against these risks. Of special interest is a discussion of new financial products and structures to meet and manage challenges to old-age security. Examples considered include pension investment guarantees and hedges, adapting catastrophe bonds to the pension context, and key regulatory structures and portfolio requirements designed to protect unwary or unwitting pension participants. The contributors draw important lessons for a wide range of countries, drawing from both developed and developing market experiences. Contributors include world-famous finance experts and risk management faculty, development economists, pension regulators, and pension consultants.

The publication of this book is timely insofar as it explores ways of enhancing retirement security in the volatile financial environment many employees find themselves in. It is the first in a new series produced by the Pension Research Council of the Wharton School of the University of Pennsylvania in collaboration with Oxford University Press.

On the global side, there is a chapter on money-back guarantees in individual pension accounts, featuring Germany. There are also chapters on retirement guarantees in compulsory defined contribution systems and in voluntary defined contribution plans, with the latter covering:
    -Belgium,
    -Brazil,
    -Denmark,
    -Germany,
    -Japan,
    -New Zealand
    -Sweden,
    -the UK, and
    -the USA.

The chapter I enjoyed the most-and thought excellent-was the one on the role of company stock in defined contribution plans by Olivia S. Mitchell (also an Editor of the volume) and Stephen P. Utkus. It is beatifully clear and explains, among other things, why defined contribution plans in the United States were not made subject to the 10% limit on employer stock that defined benefit plan holdings became subject to under the Employment Retirement Income Security Act. When ERISA became law (in 1974) Congress chose not to extend the limit to defined contribution plans because they were mainly profit-sharing plans, to which employers made variable plan contributions based on company earnings, and Employee Stock Ownership Plans, which by design encouraged employers to make employer stock contributions in an effort to encourage employee ownership. They were thus not widely used as a retirement income vehicle and in many large companies they were in additon to defined benefit plans. Remember, also, that this was an era well before the use of 401(k) plans. Employees therefore did not have all their eggs in one basket. This lack of a limit for defined contribution plans explains how Enron employees-and those in similar companies-could be hit so devastatingly in respect of their future retirement income as well as losing their jobs when their companies folded nearly 30 years after the enactment of ERISA (a piece of social legislation), something that has bemused pension practitioners outside the United States ever since. Mitchell and Utkus comment that one striking finding is that 401(k) plan participants tend to believe that their own company's stock is safer than other individual company stock and also safer than a stock-market index. The authors outline policy options for future plan design so that this problem can be avoided.

This book explores several types of risk that confront employees, retirees, companies, and governments in the retirement context. The focus in this volume is on how pension systems can help protect against such risks, particularly in light of the current uncertain economic and financial global environment. Of particular interest is the question of whether and how financial products and systems can be better designed to meet and manage retirement risks. Examples considered in this book include guarantees and hedges for pension investments, catastrophe bonds, and alternative regulatory structures and investment restrictions intended to protect unwary or unwitting pension plan participants. Chapters draw important lessons from a wide range of countries, focusing on both developed and developing countries. Contributors include finance and insurance sector experts, development economists, regulators, and academics.

        Book Description

The new edition of this book continues to be one of the leading works on competition law for students, and the ideal companion to the author's Introductory Guide to EC Competition Law and Practice (8th edition, 2004), also published by Hart Publishing. The book has been completely updated to take into account recent developments in EC competition law, including the modernisation effected by Regulation 1/2003, the Merger Regulation and changes to the rules on IP and competition law. As such it remains an invaluable work of reference for law students and practitioners seeking a succinct compilation of cases and other materials, accompanied by the author's penetrating and often critical observations and analysis. The bulk of the text is made up of extracts from Commission Decisions, Opinions of the Advocates General at the ECJ, and judgments of the ECJ and CFI. These are supplemented by extracts from EC legislation, and comments, notes and questions prepared by the author. The text is up to date as of June 2006.

I used this book to study for a postgraduate competition law course at Oxford. The book recommend by the professors was Whish. However Whish is outdated and has a tendency to explain the irrelevant rather than the relevant.
This casebook focuses on the relevant cases and gives the relevant pointers and questions to make it clear. I would recommend to combine this book what the book European Competition Law and Economics by R.J. van den Bergh and P.D. Camesasca or EC Competition Law by Goyder.

        Book Description

This is the eagerly awaited new edition of the market-leading volume EU Law: Text, Cases and Materials. Written by two experts in the field, the book offers the reader an authoritative and comprehensive guide to all aspects of EU Law (both institutional and substantive). Through the unique mix of 50% text and 50% cases and materials the fully revised and updated third edition addresses all recent key developments in legislation, with particular focus on the Treaty of Nice. The structure and format of the chapters have been substantially improved by introducing tools to help the reader navigate through the text, and by the division of some chapters into two: including those on Community Legislation and Competition Law: Article 81.

        Customer Reviews:

4 out of 5 stars Definitive but boring.......2006-04-02

I bought this book because it was recommended by the University of Maastricht (Netherlands) as a textbook to study for the entrance exam that must be passed for non-lawyers to take their Master's course in European Law. I also recently saw it as part of the library of the Munich Intellectual Property Law institute - a program I am also considering.

This book provides definitive coverage of European law and some community institutions. The index, table of cases and acronym definitions are thorough. The history of the European Union and European institutions is laid out and important paragraphs from numerous European Court decisions are quoted and their implications are analyzed.

It is also incredibly boring to read. No author can save the mind-numbing decisions of the European Court. The convoluted and nearly impenetrable language is almost beyond mortal understanding. However, the analysis is also very dry - and while the cause of objectivity is a noble one, an occasional subjective opinion can make a book far more readable. The authors also occasionally refer to cases before explaining them - giving the impression that the book was, at least partially, compiled from previously written articles. This is a bit irritating - particularly in a 3rd edition, you would think that sort of thing would have been filtered out in the previous two versions.

Despite its flaws, this book is useful as a reference and has value for anyone making a serious study of European Law. I would not recommend trying to read it cover-to-cover. How about taking a stand in the next edition? Spice things up a little. In Hartley's, European Union Law in a Global Context, the author makes his point of view known throughout the book, and while the reader may not always agree - it makes the material ever so much more interesting. It would be nice to see something similar from Craig and De Burca, particularly since this book appears to be considered definitive by at least 2 European academic institutions.

5 out of 5 stars Simply The Best.......2004-02-04

I used this book in England where it is the standard text. I'm now studying EU law in the US and am struggling through Bermann, Goebal et al (West 2002). Craig & De Burca is a clear and comprehensive exposition of all the substantive EU law. It also provides some structural background on the EU, though admittedly not as much as the Bermann book and therefore possibly not as much as is necessary for a standard US law school course. Nevertheless for anyone who wants a clearer understanding of EU law, I cannot recommend this book more highly.

        5 out of 5 stars Excellent!.......2001-07-18

This is the most detailed and best written textbook on EU law that I have seen so far. I use it as a reference all the time.

        3 out of 5 stars usefull.......2000-11-01

i found the book very usefull and helpfull in my EU law graduate studies and i wish we will have a new updated edition of the book.

              Book Description

The European Convention on Human Rights and Fundamental Freedoms is by now tremendously influential in the legal practice of over forty European states, including the United Kingdom. It is therefore essential that students and lawyers be familiar with the law and procedures of the European Court of Human Rights in Strasbourg. This second edition of the innovative and highly acclaimed European Human Rights Law has been extensively updated to cover the major developments of recent years, including the reform of the European Court of Human Rights, expansion of the system to central and eastern Europe, and the incorporation of the European Convention on Human Rights into British law. The book introduces both the process and the substance of this increasingly important area of European law. Presenting extracts from key cases alongside clear and intelligent commentary, Janis, Kay, and Bradley explain the legal rules and court system that has evolved in Strasbourg, how the Court works, and how European human rights law is enforced both at the national and international level. It also puts European human rights law into a useful comparative framework alongside human rights cases decided by courts in the United States and Canada.

                      Book Description

Cases and Materials on Company Law guides students through the complexities of company law with a broad selection of source materials that are placed in context through clear commentary. It covers all the principal areas of company law including the issue of securites and insolvency. The book concentrates on how the law facilitates and regulates the operation of companies, both large and small, reflecting the realities of current practice. To help students understand the signficance of the material presented, each section is preceded by a concise introduction. Similarly, each case is preceded by a statement of its legal significance and a summary of the main facts. The book has been fully revised to incorporate the groundbreaking changes to domestic company law as a result of the Companies Act 2006. The new edition has been made easier to navigate as a result of a new two colour text design that clearly differentiates extracted material from the authors' commentary.

                        Book Description

This is the first of three planned volumes which deal with the techniques and technology of agriculture in Europe in the period from 600 A.D. down to the 17th century. The focus of this first volume is Scandinavia, the British Isles, Northern Germany, the Low Countries and Northern France. The volume discusses methodological approaches and their limitations, the development of medieval agriculture in terms of the transmission of technological ideas, improvements in productivity, regional variations, social responses to agricultural technology, and those common trends that unite the Northwest European region. The volume integrates material derived from the great advances made in medieval archaeology and the historical study of landscapes during the past 30 years and has a supranational character. It will be of interest to all those working on the social, economic and political history of Northwest Europe in the medieval and early modern periods as well as to those undertaking research in the specific field of the history of technology. Technology and Change in History This new series of scholarly surveys is intended to offer an updating of the discussion of questions regarding the nature of technology and technological change first broached in the nine-volume survey by R. Forbes: Studies in Ancient Technology. The series will however take in not only the original scope of Forbes' work, namely the Ancient Near East and the Greco-Roman world, but will extend beyond this to cover the medieval and early modern periods. The volumes in the series will be in English, of 300-800 pp., divided into 10-15 topical chapters and aim to present to scholars, graduate students and to non-specialist scholars the current state of knowledge in the various fields in the history of technology. They collect, assimilate and present facts, opinion, sources, and literature in the accessible way that Forbes did, but will also identify issues that have not been plainly addressed and will in doing so indicate where the field might profitably be going. Including notes and numerous illustrations, the volumes address questions of a primarily historical nature, such as: 1. what technological options were open to peoples at different times and different places? 2. what options did they choose and why? 3. what impact did this have on their contemporaries and successors (and on their technological choices)? Questions and problems more proper to political, social and economic history will also be touched upon, but the starting point and focus of this new series is the history of technology. Volumes planned in the series include: R.J. Curtis: Food Technology in Antiquity (1999) M.-C. Deprez-Masson and N.J. Mayhew (eds.): Metal Technology: 600-1800 A.D. (2001) P. Squatriti (ed.): Medieval Hydrotechnology (2001) O. Wikander (ed.): Ancient Water Technology (1998) G.R.H. Wright: Ancient Building Technology (1999) J. Langdon and G. Astill (eds.): Agrarian Technology in the Middle Ages: Northwest Europe (1996)
