    It should be noted that much of the information in this book was derived from ongoing discussions with Department of Defense officials. In this regard, at the U.S. Navy Pacific Fleet Command we thank Captain John Morris, Comptroller, and in the Pacific Fleet Budget and Planning Directorate, Heidi Allan, Ed Butziris, Vicki Catton, Brian Overby, Randall Scott, and Geri Shishido. Over the period 1986 to 2003 we conducted interviews with Navy Fiscal Management and Budget (FMB) officials in the Office of the Assistant Secretary of the Navy, Financial Management, and Comptroller, including every FMB Director (N82, a two-star admiral) in office since 1986. In addition, we interviewed various financial management and budget offi- cials in the Office of the Secretary of Defense, including several DOD comptrollers, and senior officials in the Financial Management Directorate of the United States Marine Corps, the Office of the Secretary of the Army, and the Office of the Secretary of the Air Force. Also, interviews were performed in numerous Navy installation and type command comptrollers' offices. In all of these interviews we gave officials a guarantee of anonymity. For this reason in most cases they are not cited by name in the text.

        While Levi clarifies much that's uncertain about legal interpretation, I don't recommend this book for those with no previous studies in law. If you must read it -- and there ARE rewards from doing so -- be sure to have a law dictionary at hand.

        Besides using legal terms that aren't explained, Levi's prose is so dense as to be almost unreadable, but worse, it lacks anything resembling clarity. He often barges straight in to lengthy analyses of concepts without explaining the basic terms he uses or even why they're relevant; these must be induced from the text while reading. Since Levi is usually demonstrating through examples how concepts change over time, however, it's difficult to pin down what the concept means at any one point, before Levi has already jumped ahead to the next point without explaining either.

        It's also highly recommended that you look up the cases Levi cites, since his quotations from judges rarely contain enough critical information to piece together the actual concept involved. Finding the original and just reading the parts that he replaced with ellipses add an infinite degree of clarity.

        I appreciate Edward Levi's attention to detail. This book definitely goes beyond the standard textbook in terms of putting together a guide that is both interesting to read and informative. I'd recommend it to anybody in my situation, planning to attend law school, or even to practicing attorneys in need of a handy, compact reference guide to the basics.

        The power to determine the law of the land resides within every citizen of the country by means of electing the officials they choose and the judicial system only upholds the law. The citizens of a country elect their leaders and once elected they are enshrined with the right to uphold the economic and political stability but any improper actions of a government should be corrected by means of the judicial process rather than by any political process. All differing opinions should be allowed to coexist with checks and balances as determined by the judicial system.

        Legal reasoning is famously ambiguous: there's no objective way to determine the outcome of a given case as there is with a physics problem. If you know the weight of an item and the height from which it drops, you are able to determine fairly objectively (i) the rate at which it will fall to the earth and (ii) the time it will take to fall to the earth from the point at which it is dropped. Law, unfortunately, is not so straight-forward. Understanding its assumptions is absolutely critical to developing any sort of sophisticated understanding about the ways in which law affects civilization. This book provides a broad outline of those assumptions. I suggest having at least a rudimentary background in intellectual history and political philosophy to get the most out of this book.

            I am currently a "1L" at a school in Washington DC.

            Professor Vandevelde introduces the reader to a brave new world: legal reasoning. As a first year law student, you will become intimately aquatinted with such creatures as Contracts, Constitutional Law, Civil Procedure, and the peculiar little buggers known affectionately as Torts. But what you will need most on your adventure, you will find strangely absent: a map & compass. "Thinking Like a Lawyer," in my opinion, in simply that. Vandevelde's text effectively explains what legal reasoning entails, how it evolved into the beast that it is, and what makes it live and breathe. Further, T.L.A.L. is written in a very readable prose you will appreciate more and more once you've tasted a few clumsy judicial opinions. Most insightful and practical, in my opinion, are the final chapters, which illustrate the material by applying it to each of the first year's courses. I recommend this book, without reservation, to any now-or-future law student, and anyone curious about legal thought and application.

            By the way, I met Mr. Vandevelde once, in 1997, at a law schools' forum held at the World Trade Center. A sincerely friendly man.

              5 out of 5 stars Priceless tool for 1L's and other law students.......2004-03-29

              During my first year of law school I asked my "legal research and writing" professor for an excellent and clearly written introduction to legal reasoning. He recommended Professor Burton's book.

              This book will "demystify" all the bulls**t that first year professors want you to figure out for yourself. If all 1L's read this book, more law students will acquire a full skill-set during first year. Instead, the irrational legal educational system prefers to teach fear, insecurity, stress, and other unnecessary lessons that do not benefit law students, lawyers, or the public which we all aim to serve. Law professors shouldn't worry because they can still teach discipline, the art of inquiry, and HELP students LEARN.

              Caveat: This book is not the Holy Grail. You still have to read all your cases and study for your exams. However, you will better understand "The Big Picture" and write an excellent exam if you take the time to understand what Professor Burton has clearly imparted in this book.

              If you appreciate what I've said, feel free to ask me for more advice on how 1Ls and other law students can stop wasting time and reduce fear, insecurity, and stress.

              4 out of 5 stars Excellent Introduction to legal theory and reasoning..........2001-06-21

              in an easy-to-read short book. Burton has given the beginning student of law and layperson a very approachable introduction in plain language. A must for first-year law students or 1L's-to-be to put their learning into a context of legal theory. A good primer before moving onto reading Cardozo's The Nature of the Judicial Process and the Hart's The Concept of Law, both of which I'd recommend to 1L's interested in jurisprudence. Burton's primer is an introduction to how cases and rules relate in analogical and deductive legal reasoning; how legal reasons, conventions, policy, purposes, and not just rules alone, are used to help lawyers make predictions and judges make decisions. Finally, it concludes with a brief chapter on the legitimacy of our legal system. Core foundational ideas from which any law student begins to build his/her knowledge and understanding and then application of legal reasoning.
