    Nearly seventy years after the last great stock market bubble and crash, another bubble emerged and burst, despite a thick layer of regulation designed since the 1930s to prevent such things. This time the bubble was enormous, reflecting nearly twenty years of double-digit stock market growth, and its bursting had painful consequence. The search for culprits soon began, and many were discovered, including not only a number of overreaching corporations, but also their auditors, investment bankers, lawyers and indeed, their investors. In Governing the Modern Corporation, Smith and Walter analyze the structure of market capitalism to see what went wrong. They begin by examining the developments that have made modern financial markets--now capitalized globally at about $70 trillion--so enormous, so volatile and such a source of wealth (and temptation) for all players. Then they report on the evolving role and function of the business corporation, the duties of its officers and directors and the power of its Chief Executive Officer who seeks to manage the company to achieve as favorable a stock price as possible. They next turn to the investing market itself, which comprises mainly financial institutions that own about two-thirds of all American stocks and trade about 90% of these stocks. These investors are well informed, highly trained professionals capable of making intelligent investment decisions on behalf of their clients, yet the best and brightest ultimately succumbed to the bubble and failed to carry out an appropriate governance role. In what follows, the roles and business practices of the principal financial intermediaries--notably auditors and bankers--are examined in detail. All, corporations, investors and intermediaries, are found to have been infected by deep-seated conflicts of interest, which add significant agency costs to the free-market system. The imperfect, politicized role of the regulators is also explored, with disappointing results. The entire system is seen to have been compromised by a variety of bacteria that crept in, little by little, over the years and were virtually invisible during the bubble years. These issues are now being addressed, in part by new regulation, in part by prosecutions and class action lawsuits, and in part by market forces responding to revelations of misconduct. But the authors note that all of the market's professional players--executives, investors, experts and intermediaries themselves--carry fiduciary obligations to the shareholders, clients, and investors whom they represent. More has to be done to find ways for these fiduciaries to be held accountable for the correct discharge of their duties.

                  The global financial crisis of 1997-8 revealed that emerging market nations as well as the developed economies are vulnerable to the forces of globalization. It highlighted the need for the governance of the world economy to catch up with the pace and degree of integration through trade and financial markets.This book argues passionately in favour of the benefits of free markets, despite the crisis. Coyle argues that the freedom to exchange and invest is valuable in itself, like other freedoms, and that it is also the only sure route to economic development. Further liberalization of trade and investment, appropriately regulated, is essential if developing countries are to attain higher living standards. Economic growth, in turn, will slow population growth and create a constituency for environmental action in the developing world.Coyle also makes the case for a reassessment of the role and capabilities of the international financial institutions. She argues that these need to reflect a more even balance of power, despite the dominance of the US in today's world economy, and that they need to live up to their own rhetoric of transparency and accountability. Chapters on trade and financial markets look in particular at the role of the WTO and IMF, the key villains on the world stage in the eyes of many progressive development campaigners. The book also addresses the shifting political economy of international governance, looking at the way information technology has led to the development of a global opposition to the inter-governmental organizations.This book will be read by students of economics and politics, and all those interested in debates about the nature and trajectory of the world economy.

                        Well written, containing all the neccessary information and forms, this book is an invaluable resource for those individuals who are interested in legally changing their name in California.

                        Pro's and con's are examined about Court Ordered Name Changes and Common Usage methodologies. Well thought out and written in a very readable and comprehensive style...this book answers almost any question you may have regarding the implications of changing you name.

                        Highly recommended....by far, the best book I have seen on the market around this issue.

                        I'm really enamored of Nolo Press's self-help legal guides. This one saved me $400 in legal fees. Just follow the steps outlined and it will guide you safely through even a court hearing, if you want to be able to change your passport. If, in the process, you decide you want to change any deeds your old name appears on, you can use their quite inexpensive guide to updating Deeds in California. As for typing up the forms -- neat printing does the job, too.

                        The 7th edition of this book was my main reference as I successfully completed a legal name change. It did a good job helping me through the process without the assistance of a lawyer ("In Pro Per"). I would also suggest finding a good paralegal to help in typing up the forms.

                        The best thing I got out of this book was the fact that you don't need to do anything to change your name other than just using it. It is called "common usage".

                        In fact, when people throw away hundreds of dollars to have a "legal name change" in a court, they are only getting a peice of paper by the court that certifies that you yourself changed your own name, as they have no authority to change your name, only YOU can do that.

                        A perfect example is when a woman gets married. The marriage certificate has her maiden name printed on it, and is not an official name change. The woman can decide HERSELF if she wishes to keep her maiden name, or use her husband's name. To use her husband's name, she just USES it and notifies everyone of her name change.

                        Likewise, after a divorce, the woman does not need to go to court of file expensive papers to change her name back, she and she alone has the authority to do that.

                        But men have that same legal right as well, and marriage doesn't even have anything to do with legally changing your name.

                        Yes, it is getting increasingly difficult to get certain companies, drivers license facilities, and Social Security to change your name, only because most times the person you are dealing with is ignorant of the law and not educated on the fact that you don't need to show them any court papers of a name change, or a marriage certificate.

                        I have found that when you run into someone that gives you a problem, call or come back another day and talk to someone else.

                        If the DMV or SS doesn't want to do it, go to the OTHER one and see if they will do it, then use that form of ID and go back to the other one, and that usually works for most people.

                        Since 9/11, many states are trying to implement rules with their DMV and such that are going against our rights to change our names on our own without any courts or fees. But this is not the first time states have made laws or procedures that went against federal laws or constitutional rights, so you just have to educate them of thier mistake.

                        Ironically, changing the name on drivers license and SS card was not a problem. Utilities and credit cards even easier yet. But a certain loan company seems to want to be difficult and refused to update their records to the new name. They are just ignorant and uneducated to the facts, and refuse to accept a state driver's license or Social Security Card as proof of name change. They say they want to see a copy of a marriage certificate. Yet no marriage certificate can be shown to them, as the county did not require you to purchase a copy in order to be married, so there is nothing to show, but even if a copy WAS available, it would show the MAIDEN name of the woman, and is NOT PROOF that the woman decided to change her name and use her husband's name instead.

                        So long as you are not changing your name for purposes of fraud, anyone can change their name themselves, just by "common usage" and using the name and notifying everyone that they changed thier name.

                        If you are lucky, you can find a lawyer friend, or one that will not charge you hundreds of dollars to type you up a letter on thier letterhead that states the law that you changed your name yourself and no court documents or visits are needed. Then you can send a copy of that letter to all the uneducated ignorant companies that refuse to update their records with your name change.

                        Remember, just because a company refuses to understand your rights, doesn't mean you need to spend hundreds of dollars to get a court document.
